These Terms and Conditions ("Terms") govern the provision of services by Xagiwa ("Xagiwa", "we", "us", "our") to any individual who engages our services or uses our website (the "Client", "you"). By booking a consultation, placing an order, or otherwise using our website, you agree to be bound by these Terms. If you do not agree, please do not use our services or this website.
Xagiwa provides home organisation services, specialising in the planning, design and practical organisation of storage and living space within residential apartments. We are based in the United Kingdom and operate in accordance with English law.
You can contact us using the following details:
Orders for our space organisation services may be placed via our website, by email, or by telephone. An order is treated as a request for services and does not constitute a binding contract until we have confirmed acceptance in writing (including by email).
Confirmation will typically include the scope of the service, the estimated date of attendance, and the agreed price. Please check all details carefully upon receipt and notify us promptly of any errors. We reserve the right to decline any order, for example where the requested service falls outside our capacity or expertise, or where the property is not accessible or suitable for the work requested.
All prices are quoted in pounds sterling (GBP) and, unless otherwise stated, are inclusive of any applicable value added tax (VAT). Our quotations cover labour, planning consultation, and standard organisational materials as specified in the confirmed order. Any additional items, bespoke storage solutions, furniture, or third-party products are not included unless expressly agreed in writing.
Payment terms will be confirmed at the time of booking. We accept payment by the methods indicated on our website or in our order confirmation. Full payment, or an agreed deposit, is generally required before work commences, with any balance due upon completion, unless otherwise agreed in writing.
We reserve the right to amend prices for services not yet confirmed. Once an order has been confirmed, the agreed price will not change except where the scope of work is altered at your request.
If you are a consumer and have booked our services at a distance (for example via our website or by phone) without an in-person meeting prior to booking, you generally have the right to cancel within 14 days of confirmation, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you request that work begins before the end of this period, you may lose the right to cancel once the service has been fully performed, and you may be required to pay for services already provided.
To cancel, please contact us at [email protected] or by telephone at +44 121 436 8001, providing your order details.
If you are unhappy with any aspect of our service, please contact us as soon as possible using the details above so that we can investigate and seek to resolve the matter promptly and fairly. We aim to acknowledge complaints within 5 working days.
Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
Subject to the above, our total liability arising out of or in connection with the services shall not exceed the total amount paid by you for the relevant order. We shall not be liable for any indirect, special or consequential loss, including but not limited to loss of income, loss of enjoyment, or damage arising from pre-existing conditions of the property or items not disclosed to us prior to the commencement of work.
We will take reasonable care when working within your home; however, you remain responsible for removing or securing valuable, fragile or sentimental items prior to our attendance, unless otherwise agreed.
Our website uses a single cookie, cookie_choice_v1, which stores your
consent preference for a period of one year. This site does not use analytics cookies,
tracking pixels, or any third-party monitoring tools. Advertising measurement, where
applicable, is only activated after you provide consent, and operates solely on the order
confirmation page.
For details on how we handle personal data, please see our separate Privacy Policy. If you have any questions about your data protection rights under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, you may contact us directly, or lodge a concern with the Information Commissioner's Office (ICO), the supervisory authority for data protection in the United Kingdom.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory consumer protections available to you in your place of residence.
We may update these Terms from time to time to reflect changes in our services or legal requirements. The version published on our website at the time of your order shall apply. We encourage you to review these Terms periodically.
For any questions regarding these Terms, please contact us at [email protected] or +44 121 436 8001, or write to us at 93 Alcester Road, Birmingham, B55 9BT, United Kingdom.
